Terms of Service — FairwayIntel

1. Agreement to Terms

By accessing or using FairwayIntel ("the Service"), operated by FairwayIntel ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Beta Service

FairwayIntel is currently in beta. The Service is provided on an "as-is" and "as-available" basis. During the beta period:

Features may change, be added, or removed without notice.
The Service may experience downtime, bugs, or data inaccuracies.
We do not guarantee uptime, data accuracy, or uninterrupted access.
Beta access may be revoked at any time at our discretion.

3. Account Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use the Service.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose.
Scrape, crawl, or extract data from the Service by automated means.
Attempt to gain unauthorized access to any part of the Service.
Submit false, misleading, or malicious content (including course reports and corrections).
Interfere with or disrupt the Service or its infrastructure.
Impersonate another person or entity.

5. User-Submitted Content

You may submit course condition reports, corrections, suggestions, and round data ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and incorporate that content into the Service. You represent that your submissions are accurate to the best of your knowledge.

6. Course Intelligence Data

FairwayIntel provides AI-generated course intelligence, including FairwayIQ scores, condition estimates, pace predictions, and weather impact analysis. This information is generated from multiple data sources and AI models. It is provided for informational purposes only and should not be relied upon as the sole basis for any decision. We do not guarantee the accuracy, completeness, or timeliness of any course intelligence data.

7. Intellectual Property

The Service, including its design, code, algorithms, FairwayIQ scoring system, and AI-generated content, is owned by FairwayIntel and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Limitation of Liability

To the maximum extent permitted by law, FairwayIntel and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is less.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, SECURE, OR AVAILABLE AT ANY PARTICULAR TIME.

11. Account Termination

We may suspend or terminate your account at any time, with or without cause, with or without notice. You may delete your account at any time by contacting us. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes via email. Continued use of the Service after changes constitutes acceptance of the updated Terms.

13. Governing Law

These Terms are governed by the laws of the State of Michigan, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the State of Michigan.
